The short version
- Every new account gets 3 free menu scans. Only successful scans count.
- Travel passes are one-off PayPal payments, from $4.99. They give unlimited scans (subject to a fair-use limit of 40 scans per 24 hours) for the stated number of days and never auto-renew.
- If swap.menu doesn't work for you, email us within 14 days of buying a pass for a full refund of that pass.
- Translations, descriptions, dietary hints and converted prices are produced by AI and can be wrong. Always check allergies, ingredients and prices with the restaurant.
- Your photos and notes stay yours. Anyone you give a waiter link to can see that order.
- Nothing in these terms takes away your rights under the Australian Consumer Law.
1. About these terms
These Terms of Service ("Terms") are an agreement between you and XTO Pty. Ltd. ("we", "us", "our"), the Australian company that operates swap.menu at swap.menu (the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. What swap.menu does
swap.menu helps travellers read and order from restaurant menus in other languages. You take a photo of a menu (or upload one) in your browser, and the Service uses AI to read it and show you the dishes translated into your language, with descriptions, prices, approximate conversions into your home currency and dietary hints. You can save menus, build an order, add notes, have those notes translated into the restaurant's language, and show the order to staff on your screen or through a waiter link.
3. Who can use the Service
You must be at least 16 years old to create an account or use the Service. By using it, you confirm that you are 16 or older and that you are able to enter into these Terms.
4. Your account
- Give us accurate information when you sign up, and keep your email address up to date so you can receive receipts and password reset links.
- Keep your password safe and don't share it. Use a password you don't use anywhere else.
- You are responsible for activity on your account. Tell us straight away at support@swap.menu if you think someone else has accessed it.
- Accounts are personal. Please don't share an account, or create more than one account, to get extra free scans.
5. Free scans
Each new account includes 3 free menu scans. Only successful scans count towards this allowance: if a scan fails and no menu is produced, it is not counted. Free scans are not transferable, have no cash value and are limited to one allowance per person.
6. Travel passes and payment
6.1 How passes work
- Travel passes are one-off purchases. Current passes and prices are shown on our Pricing page, from $4.99. Prices are in Australian dollars (AUD).
- Each pass gives you unlimited menu scans for the number of days stated for that pass, starting from when your payment is completed.
- Unlimited scanning is subject to a fair-use limit of 40 scans in any 24-hour period. This limit is there to prevent abuse and automated use, and is well above what a traveller normally needs. If you reach it, you'll be able to scan again later, once you are back under the limit for the 24-hour period.
- Passes do not auto-renew. When a pass ends, you won't be charged again unless you choose to buy another one.
- Your saved menus and orders stay in your account after a pass ends. You can keep viewing them; you just need free scans or a new pass to scan new menus.
6.2 Payment
Payments are processed by PayPal. You'll complete your payment with PayPal, and PayPal's own terms apply to that payment. We never receive or store your card details. If you pay with a card or account in a currency other than AUD, PayPal or your bank may convert the amount and may charge their own conversion fees.
We may change our pass prices or the passes we offer from time to time. Changes won't affect a pass you have already paid for.
7. Refunds and your rights under the Australian Consumer Law
7.1 Our 14-day refund promise
If swap.menu doesn't work for you, email us at support@swap.menu within 14 days of buying a pass and we'll give you a full refund of that pass. Please include the email address on your account and, if you have it, your PayPal receipt. Refunds are made through PayPal to the account you paid from.
This promise is in addition to your rights under the Australian Consumer Law. We may decline a refund request where there has been clear misuse of the Service, such as breaching the acceptable use rules in section 11, but this never limits the rights described in section 7.2.
7.2 Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. If you are a consumer in another country, you may also have rights under your local consumer laws that these Terms do not affect.
8. AI results: please read this
Translations, dish descriptions, dietary and allergen hints, and converted prices are generated automatically by AI from your photos. They may be wrong or incomplete.
- The AI can misread a photo, mistranslate a dish, miss an ingredient, or get a price or currency wrong, especially with handwriting, glare, unusual fonts or local dishes.
- Dietary and allergen hints are a guide only. They are based on what is visible on the menu and general knowledge of the dish, not on the restaurant's actual recipe or kitchen.
- Converted prices are approximate. They use exchange rates from a third-party feed that may not match the rate your bank or card provider applies.
- Always confirm allergies, ingredients, preparation and prices with the restaurant before you order.
- Never rely on swap.menu as the only basis for decisions about allergies, intolerances or medical dietary needs. If you have a serious allergy, carry a reliable written allergy card and speak to staff directly.
We are not the restaurant. We are not responsible for the food or drink a venue serves, how it is prepared, or what the venue charges you. Any dispute about an order, a bill or a meal is between you and the venue. This section does not limit your rights under the Australian Consumer Law, including the guarantee that our services will be supplied with due care and skill.
9. Your content
"Your content" means the menu photos you upload and the orders, notes and other information you add to the Service.
- You keep ownership of your content. We don't claim any ownership of it.
- Licence to us. You give us a non-exclusive, worldwide, royalty-free licence to store, copy, process and display your content only as needed to provide the Service to you. This includes sending menu photos and order notes to our AI provider (currently Google's Gemini API) so they can be read and translated, and displaying an order through its waiter link when you share it. This licence ends when you delete the content or your account, except for anything we are required by law to keep.
- Your responsibility. You confirm that you are allowed to photograph and upload the menus you scan. Menus are usually displayed publicly for customers to read, but please respect any venue rules or requests not to take photos, and try to keep people and other personal details out of the frame.
- Please don't put sensitive personal information in order notes, especially if you plan to share the waiter link.

10. Waiter links
Each order has a waiter link and QR code so you can show it to restaurant staff. Waiter links are shareable by design: anyone who has the link can see that order's dishes, notes and total. The link doesn't show your name or contact details. The link's code is long and random so it cannot practically be guessed, but you decide who you share it with, so please share it only with people you want to see the order.
11. Acceptable use
You agree not to, and not to help anyone else to:
- scrape, crawl or harvest data from the Service, or use bots, scripts or other automated means to scan menus or access the Service;
- copy, modify, decompile, reverse engineer or attempt to extract the source code of the Service, except where the law expressly allows it;
- resell, sublicense, rent or commercially exploit the Service or access to it, or use it to provide a menu-translation service to others;
- try to get around free scan allowances, pass terms or the fair-use limit, including by creating multiple accounts;
- probe, test or bypass our security or authentication, access another person's account or data, or interfere with or overload the Service;
- upload anything unlawful, abusive, harassing, obscene or infringing, or anything other than menus or related material the Service is designed for;
- use waiter links or order notes to harass, threaten or abuse restaurant staff or anyone else; or
- use the Service in any way that breaks the law or these Terms.
12. Our intellectual property
The Service, including its software, design, text, graphics and the swap.menu name and logo, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the Service for your own, non-commercial travel and dining purposes in line with these Terms. You don't get any other rights in the Service.
13. Third-party services
The Service relies on third parties, including Google (for AI menu reading and translation), PayPal (for payments), an exchange rate feed (for currency conversion) and, for voice dictation, the speech recognition built into your browser or device. Their services are governed by their own terms and policies. We are not responsible for the availability or accuracy of third-party services, except to the extent the Australian Consumer Law makes us responsible.
14. Availability and changes to the Service
- Scanning, translation and currency conversion need an internet connection. Saved content may not be available if you are offline or have a poor connection.
- We work to keep the Service running smoothly, but it may sometimes be unavailable because of maintenance, faults or problems with our providers. We don't guarantee it will always be available, uninterrupted or error-free.
- We may add, change or remove features over time. If we make a change that significantly reduces what you get from a pass you have already paid for, we will tell you and you can ask for a refund of the unused portion of that pass.
To the extent permitted by law, and subject to section 7.2, the Service is provided "as is" and "as available", and we exclude all warranties and conditions that are not expressly set out in these Terms.
15. Limitation of liability
Nothing in this section limits any liability that cannot be limited by law, including under the Australian Consumer Law.
Subject to that, and to the extent permitted by law:
- we are not liable for any loss or damage arising from your reliance on AI-generated translations, descriptions, dietary or allergen hints or converted prices without checking them with the restaurant, as section 8 asks you to do;
- we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or opportunity; and
- our total liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the total amount you paid us in the 12 months before the event that gave rise to the claim.
Our liability is also reduced to the extent that any loss was caused or contributed to by you or by circumstances outside our reasonable control.
16. Suspension and termination
16.1 By you
You can stop using the Service at any time, and you can delete your account at any time from Profile → Delete account. Deleting your account permanently removes your menus, photos and orders. Deleting your account doesn't by itself entitle you to a refund of a pass, but it doesn't affect your rights under section 7.
16.2 By us
We may suspend or close your account, or restrict your access to the Service, if you seriously or repeatedly breach these Terms, if we reasonably suspect fraud, abuse or automated use, or if we are required to by law. Where reasonable, we will tell you first and give you a chance to fix the problem. If we close your account without good reason related to your conduct, we will refund the unused portion of any active pass.
If we decide to stop offering the Service altogether, we will give you reasonable notice and refund the unused portion of any active pass.
Sections that by their nature should continue after these Terms end (including sections 7, 8, 12, 15 and 18) will continue to apply.
17. Changes to these Terms
We may update these Terms from time to time, for example when we change our passes or features or when the law changes. We will post the updated Terms on this page, update the "Last updated" date and, for significant changes, give notice on the site. Changes apply from the date they are posted and won't apply retrospectively to passes already purchased in a way that disadvantages you. If you continue to use the Service after a change, you accept the updated Terms. If you don't agree, you can stop using the Service and delete your account.
18. Governing law
These Terms are governed by the laws of Australia and of the State or Territory in which XTO Pty. Ltd. is registered. You and we submit to the non-exclusive jurisdiction of the courts of that State or Territory and the federal courts of Australia. This doesn't take away any right you have under the laws of the country you live in to bring a claim in your local courts.
19. General
- If any part of these Terms is found to be invalid or unenforceable, it will be read down or removed to the extent necessary, and the rest of the Terms will continue to apply.
- If we don't enforce a right under these Terms straight away, that doesn't mean we have given it up.
- You may not transfer your rights under these Terms to anyone else. We may transfer our rights and obligations to another entity that takes over the Service, provided your rights under these Terms are not reduced.
- These Terms, together with our Privacy Policy and the pass details shown on our Pricing page when you buy, are the whole agreement between you and us about the Service.
